Products Liability
Injuries can occur in seemingly harmless situations when products used in everyday life are defective or suddenly malfunction. Consumers rightly expect the things we use daily in our homes and workplace to function properly. When manufacturers, distributors, suppliers, or retailers provide a product that fails and causes injury to you or death to a family member, you should seek compensation.
Examples of past products liability cases include:
- $1.025 million settlement for the wrongful death of a delivery man who fell out of a truck due to a defective door
- $1.9 million settlement for a person rendered quadriplegic in an automobile rollover accident when the roof crushed
- $605,000 settlement for a child whose left leg had to be amputated below the knee after being backed over by a riding lawnmower
- $370,000 settlement for a person whom suffered 2nd degree burns to the upper body following an explosion of a hot water heater.

Dangerous or Defective Drugs
There are several major issues with the approval and manufacture of drugs. All can cause serious illness or death.
- Drugs approved by the Federal Drug Administration (FDA) then found to have harmful side effects over a longer timeframe
- Drugs having an undiscovered—until it was too late—conflict with other drugs or foods
- Medications that were improperly manufactured and do not meet specified purity or dosage levels.

File your claim as quickly as possible
The product must be preserved for a products liability case! It is critical to contact an attorney as soon as possible. A potential products liability case should be investigated before memories fade, physical evidence is lost, and the condition of the product deteriorates. The longer the wait before seeking legal counsel, the more difficult it is to prove a product liability cause of action.
North Carolina limits the time you have to bring a claim against the manufacturer, supplier, or retailer of a defective product in two ways. Under Statutes of Limitation, a lawsuit must be filed within three years of an injury or within two years of a death. In addition, under the Statute of Repose, a lawsuit must be filed within six years from when the product was first sold for use.
Therefore, for a death, a suit for a defective product must be filed before two years from the date of death or six years from the date the product was sold for use, whichever is shorter. For an injury, a suit must be filed before three years from the date of injury or six years from the date the product was sold for use, whichever is shorter.
